A Pima County Superior Court Judge has rejected a bid by a man convicted of killing a ÃÛèÖÖ±²¥ police officer to have his plea altered, officials say.
David “Nick†Delich, 29, pleaded guilty to first-degree murder and aggravated assault with a deadly weapon in the fatal shooting of Officer Erik Hite during a chase in 2008 across ÃÛèÖÖ±²¥.
Delich also pleaded guilty except insane to two counts of discharging a firearm at a residential structure, and seven counts of aggravated assault with a deadly weapon.
Delich filed a petition asking the court to modify his sentence for the last two counts from guilty pleas to guilty except insane pleas.
Under the terms of the plea, Delich will spend the next 91.5 years in the state hospital. If, during that time, the doctors find he is no longer seriously mentally ill he will be transferred to the state prison to start serving a life term, with the possibility of release after 25 years.
